What if I tried to be careful?
If a driver does their best to act reasonably given the road conditions, the courts consider this in deciding who is responsible.
A court has held that someone who drove around a corner in the dark and hit a parked truck on the inside of the corner (with no lights on), wasn't responsible for the damage. The court concluded the driver's headlights didn't light up the darkened truck, and the court found the driver was driving with reasonable caution and the truck simply wasn't visible.
