Motor vehicle collision - Our client was a passenger in a vehicle that did a U-turn in front of a vehicle moving at a high rate of speed. The resulting impact caused our client to lose consciousness. She was transported to UC Davis hospital. Additionally, she sustained an endplate compression fracture of her thoracic spine. Her medical bills alone were nearly $182,000.00 which allowed us to quickly settle her claim for the at-fault driver's policy limits. This office obtained a reduction of her medical bills by $100,000.00 allowing the client to obtain a recovery from her settlement.

Auto vs. Auto - Our client was a 35-five-year-old man driving an older model pick-up truck. He was rear-ended and upon impact, his head snapped back and hit the glass window behind his head. This resulted in disk protrusions at C4, C5, C6, and C7 with impingement of the nerve roots at C7 and C8. The case settled for policy limits.

Motor vehicle collision - Pre-Trial Injury Settlement –Concussion with Cognitive Effects –  Our client suffered relatively minor cognitive deficits stemming from a head injury after being hit by a bus.  Attorneys for the defense low balled us throughout the entire process.  We pushed for trial and practically on the courthouse steps the opposing side dramatically increased their offer to an acceptable amount.

Motor vehicle collision - Our client, a 41-year-old physician, was involved in an automobile accident.  The primary injury sustained by our client was a hyperextended thumb on her non-dominant hand, which resulted in surgery with rehabilitation and residual pain.  By successfully arguing that the residual injury could take her out of the workplace early, we were able to obtain the full insurance policy of the at-fault party, as well as the entire remainder of our client’s Underinsured Motorist policy, for a total settlement of $250,000.00.

Motor vehicle collision – Knee Injury - Horizontal tears of the lateral meniscus body and posterior horn medial meniscus 

Our elderly client suffered an injured knee as a result of a motor vehicle collision.  The defense argued that the meniscus tears which showed up on an MRI were degenerative in nature and due primarily to our client’s age, and not because of the motor vehicle collision.  With the help of an orthopedic expert, we argued successfully that either the collision caused the injuries, or that a pre-existing condition was made much worse.

Vehicle vs. Vehicle collision - Our client was rear-ended at considerable speeds when she was forced to stop her vehicle on the freeway as the result of lost cargo in a vehicle ahead of her. She was then rear-ended by another vehicle. We were successful in obtaining policy limits from Allstate (despite an initial denial of liability) who insured the vehicle who lost the cargo, and another $100,000.00 from the carrier for the vehicle that rear-ended our client who sustained shoulder and neck injuries requiring surgery to her shoulder on two occasions.

Motor vehicle collision - Our client, a 55-year-old husband and father, was involved in a multi-car rear-end accident on the freeway.  His vehicle was third in line from the initial impact.  Our client had a history of significant lumbar injuries, and following the subject accident, he obtained a few conservative procedures in an attempt to manage his symptoms and delay more aggressive care.  We argued that this accident hastened his need for future lumbar surgery.  After weeks of negotiation, the defendant’s insurance company agreed to pay $150,000.00 in settlement of the claim.

Motor Vehicle Collision: Minor neck and back injuries – Minor rear end collision. Our client was involved in a very minor rear end collision and suffered what were called by the defense “minor sprain/strain injuries” to her neck and back.  We argued that the injuries made our client a chronic pain patient because her symptoms, although relatively minor, forced her to seek help by a chiropractor and/or physical therapist a couple times a month.

Motor vehicle collision - Our client, a 32-year-old woman, was injured in a moderate rear-end impact, sustaining neck and back injuries including a disc injury at L4-L5. Our client received some symptomatic relief from conservative chiropractic care, however, her low back pain remained persistent. Following MRI studies that revealed a lumbar disc injury, she was referred to a spine specialist M.D., from whom she received additional physical therapy, spinal decompression, and paraspinal injections. The opposing insurance company’s primary argument was about a five-month gap in treatment that occurred during our client's final months of pregnancy and recovery after her child was born. The insurance company insisted that treatment afterward (which was more than two-thirds of the treatment and medical expenses) was related to stresses from the pregnancy and not the original injury. Settled during litigation for $120,000.00.

Motor vehicle collision -  A 66-year-old female was a passenger in a vehicle struck in the rear at a high rate of speed. Since it was late, she returned home. The following day, she was barely able to stand and was driven by a family member to a nearby clinic.  Her condition worsened and relatives took her to a nearby Emergency Room the following day.  Ultimately, she was diagnosed with a traumatic brain injury, a concussion, a head contusion, and a rotator cuff tear and left shoulder SLAP Type IV tear.  The claim resolved for the at-fault vehicle owner and the at-fault driver’s policy limits.

Motor vehicle collision - Our client, a small business owner, was involved in a motor vehicle collision. A driver had run a red light and turned left directly into our client’s vehicle which had been traveling straight. This client sustained neck, back and left shoulder pain. She also experienced abnormal chest pain after the collision and feared she was having a heart attack.  The following day, she was diagnosed with tachycardia associated with pain and anxiety from the injuries.  Over the next weeks, she was in and out of the hospital for treatment associated with tachycardia and abnormal atrial fibrillation/flutter.  Her physicians over the course of a year confirmed that this abnormal heart issue was directly associated with her pain levels due to her neck, back and shoulder injuries as well as increased anxiety levels post-collision.  They confirmed no other overlying issues were associated with her heart condition.  To bring down her pain levels, she sought treatment from a chiropractor.  Her physician also had her participate in a physical therapy program and acupuncture program.  Upon reduction of her pain levels, this client’s abnormal heart flutter and tachycardia improved.  Ultimately, the claim settled for the policy limits.

Motor vehicle collision - Our client, a 37-year-old male, was driving a small pickup that had proceeded through an intersection on a green light.  Unfortunately, the at-fault driver failed to see the red traffic signal in his direction and was traveling at a high rate of speed.  The two vehicles collided.  The client was seen at a local Emergency Room and subsequently began chiropractic treatment.  His injuries did not improve.  MRIs were taken and revealed a traumatic injury to the spine including a compression fracture at T8 and three-disc protrusions at L3-4, L4-5, and L5-S1.  A spinal surgeon recommended a lumbar surgery and cement augmentation of the fractured T8.  Due to limits being an issue, the case ultimately resolved for the at-fault party’s policy limits.

Motor vehicle collision - Our client was a 49-year-old female who was the front passenger in a vehicle. The defendant failed to remain in his lane and crossed over in oncoming traffic causing a head-on collision. After being taken by ambulance and given multiple radiological exams, the client was diagnosed with multiple injuries including a compression fracture of the lumbar spine. Despite having a significant case value, the claim was resolved for the maximum policy limits of the defendant driver.

Motor Vehicle Collision - As a result of a motor vehicle collision, our client suffered a Central Annular Tear at L5-S1, Bulging Disc at L4-L5, Bulging Disc at C5-C6, Neck Spasms, Radiculopathy, Chronic Neck Pain and Chronic Lower Back Pain, Back Spasms, Pain and Radiculopathy down Legs, Shoulder and Arm Pain, Chest Pain, Hip Pain, Headaches, Dizziness, Difficulty Sleeping and Fatigue. The defense, in this case, argued that: 1. Our client was exaggerating her symptoms; and 2. Any injuries she had pre-existed the subject collision. We filed a lawsuit on our client's behalf. Shortly before trial, the defense tendered their client's total insurance policy to settle this case where previously they were only offering a fraction that this amount.

Motor Vehicle Accident - Our client injured her L5/S1 disc in a motor vehicle collision, not her fault. Her symptoms following the collision included: low back pain; lumbar facet pain; lumbar discogenic pain; and sacroiliac joint pain. She obtained medical treatment with a chiropractor, a physical therapist, and a spine specialist who performed a steroidal epidural injection into her low back to help alleviate some of her symptoms.
