Q. I’ve noticed a lot of horseplay in the Roseville Galleria, and I’m just wondering whether a shopping mall like the Galleria would be responsible if someone were injured in their mall?
A. Good question, and the answer is that it depends.
The first question would be how the injury arose. Some of the injuries that occur in shopping malls are slip and fall cases, falling object cases, shopping cart injuries, overcrowding injuries and parking lot claims. Injury claims are more frequent when shopping malls are more crowded. More injuries occur on Black Friday and the frenzied Christmas Season.
If an injury occurs in a shopping mall, there must be some negligence on the part of the mall owner or a store owner that causes your injury. A store or mall must act reasonably and do whatever they can to abate dangerous or potentially dangerous conditions. For example, if a store knows that
Crowds of people are running pell mell thru a mall and causing a commotion which might lead to the fall, and if the mall does not correct that situation, that likely is a situation where an injury would be compensable.
Another situation might be where there is a wet floor because someone mopped and failed to put up a WET FLOOR sign.
In general, an injured party must prove the mall or shops in the mall had notice of a dangerous condition (Or would have had notice if they had done reasonable inspections), that the store failed to correct the condition, and the failure resulted in an injury.
If the shopping mall or a store therein is responsible, they must pay damages including medical bills past and future, lost earnings past and future as well as pain and suffering damages.

Q. I have really bad luck. Believe it or not, I had 2 accidents within 15 minutes of each other. I had an accident with over $10,000 damage to my car first. Then, on the way to the hospital, the ambulance I was in was struck and overturned and I was hurt even worse. By the time I got to the hospital, and was diagnosed, I had a fractured tibia , a torn meniscus and several fractured ribs. I’m not sure how I can prove what injury happened in the first accident and what injury happened in the second. A friend of mine in law school said I’m out of luck unless I can prove beyond a reasonable doubt who caused which injury. Am I out of luck?

I’m Ed Smith, a Roseville personal injury lawyer and I’ve been handling serious injury cases since 1982. In California, when there are two back to back accidents like you were in, the burden shifts to the defendants to try to prove which of your injuries came from each accident. If they can’t do this (and they can’t) then they are both responsible for your injuries and damage.
So, if the first driver had $15,000 per person insurance coverage and was driving a car owned by a friend that also had $15,000 coverage, there would be $30,000 available for your injuries from the first accident.
If the ambulance had $100,00 per person (A normal ambulance coverage) there would be another $100,000 in coverage for a total of $130,00 in possible coverage.
Additionally if you had higher limits than that of Underinsured Motorist coverage, you’d be able to tap into that as well.

Q. Where are the most frequent auto accidents and car crashes in Roseville?
A. Cirby Way at Sunrise Avenue has the most accidents in recent years followed closely by Sunrise Avenue and Melody Lane.
Other locations in Roseville where there are a lot of crashes are Blue Oaks Boulevard at Washington Boulevard and Foothills Boulevard and Pleasant Grove Boulevard.
Douglas boulevard at Eureka Road and Sunrise Avenue at Douglas also see a lot of accidents.
