What is Wrongful Death and How is it Caused

A wrongful death case may be brought when someone loses his or her life because of the negligence of another entity or individual. This can happen in many different ways. For example, doctors and hospitals that make mistakes and cause a patient’s death may be liable in a wrongful death case. Who is Able To Claim Compensation for Wrongful Death Claims?

Generally, the people who are able to bring wrongful death claims in California include the following:

  • Surviving domestic partners or spouses of the decedent
  • Children
  • Putative spouses or the children of putative spouses
  • Minors living with the decedent. These minors must have been dependent on the decedent and have lived with them for a minimum of 180 before the fatal incident.
