Can Grandparents recover for Wrongful Death cases in California?
Normally they cannot. The following people, if alive, would have rights before them:
A surviving spouse or registered domestic partner, any children of the marriage or issue of any deceased children, dependent stepchildren. Dependent parents and dependent minors living in the victims household for at least 6 months.
If no-one in the above sentence is alive, then, and only then, can grandparents have a right to recovery.
